But the story doesn't end with Congress.

Even before the Senate vote, the U.S. Securities and Exchange Commission (SEC) had been developing its own approach to crypto regulation.
In March, the SEC issued an interpretation addressing how federal securities laws apply to different types of crypto assets and transactions. ๏ฟฝ

Then in August, the SEC proposed โ€œRegulation Crypto Assets,โ€ including proposed exemptions and a conditional safe harbor for certain crypto-related offerings. Public comments on that proposal are due October 20, 2026. ๏ฟฝ

And just two days after the Senate setback, the SEC announced an Innovation Exemption allowing certain platforms to facilitate trading of tokenized stocks under specified conditions. ๏ฟฝ

So while Congress has not yet delivered a comprehensive statutory framework, regulators are continuing to shape the rules within their existing authority.
โ‚ฟ Why didn't the Senate setback crush Bitcoin?
Bitcoin did react initially. Reuters reported that Bitcoin fell about 4% to $75,908 after the Senate vote, alongside declines in several crypto-related stocks. ๏ฟฝ

But a single legislative setback is only one factor in a market influenced by liquidity, monetary policy, institutional demand, leverage and broader investor sentiment.
That's why the failed vote doesn't necessarily determine Bitcoin's longer-term direction.

The key question is whether Congress eventually produces legislation that creates a durable framework or whether regulators continue filling parts of the gap through interpretations, exemptions and rulemaking.
