Can You Sue Someone in Another State Through the Small Claims Court?

One of the questions I received on my post on the Small Claims Court was:

"Does it involve interstate?"

The answer is:

It depends.

Where the person who owes you money is located is often an important factor in determining which court has jurisdiction.

For example, if you live in Abuja but the debtor lives in Lekki, Lagos, the appropriate court may, depending on the circumstances, be the Magistrate Court with jurisdiction over that area in Lagos.

However, every case is different.

The facts of the case, the applicable court rules, and the nature of the claim can all affect which court has jurisdiction.

If you're unsure, you don't have to guess.

You can visit the Magistrate Court nearest to you to make enquiries about the appropriate court or seek legal advice before filing your claim. That way, you can avoid filing your case in the wrong court.
