⚖️ Gutting the CLARITY Act's Section 604 Could Push Crypto Devs Offshore
The CLARITY Act — passed by the House a year ago to replace SEC "regulation by enforcement" with clear crypto rules — is stalled in the Senate, blocked by banking opposition and partisan friction.
The sticking point: Section 604. Industry executives warn that removing it would expose open-source developers to liability without constitutional cover, triggering First Amendment legal challenges and accelerating the flight of crypto development talent out of the U.S.
No Senate vote is scheduled. The longer it drags, the more developers and projects quietly route around U.S. jurisdiction entirely.
