🚨 LEGAL TWIST AHEAD OF 2027 ELECTIONS

Nigeria’s electoral process has been thrown into fresh uncertainty after two different panels of the Court of Appeal delivered conflicting judgments on the powers of the Independent National Electoral Commission (INEC) and key provisions of the Electoral Act.

One Appeal Court panel upheld INEC’s authority to issue election guidelines and timetables, ruling that the commission acted within the law and that the Youth Party had no legal standing to challenge the guidelines.

However, in a separate judgment, another Appeal Court panel struck down Sections 77(5), (6), (7), and 84(2) of the Electoral Act, holding that they conflict with the 1999 Constitution by interfering with political parties’ constitutional powers to manage their membership registers and conduct candidate nominations.

With preparations for the 2027 general elections underway, the conflicting decisions are expected to spark further legal battles and could have significant implications for Nigeria’s electoral process.
