NDC anti defection is not a law; it is merely a party rule, and the Constitution of the country supersedes any party regulation.

What usually happens is that politicians create factions within their party, manufacture internal disputes, and then use those divisions as an excuse to defect. When the matter gets to court, the court often relies on the existence of those internal party disputes and rules in their favour.

That is why I believe the NDC rule is ineffective. Until our judiciary becomes truly independent and consistent, these rules will remain meaningless. Almost every political party has anti-defection provisions, yet the courts repeatedly override them whenever internal party crises are established.
