Many Nigerians believe that once they write a Will, they can give their properties to anyone they want. But the law says otherwise!
Here are 4 ways your Will can be overturned in Nigeriaπ
1. The Benin Kingdom Rule
If you're from Benin, you cannot give away your family's principal house (Igiogbe) to anyone except your eldest surviving son. Even the Supreme Court can cancel that part of your Will.
2. You Can't Abandon Your Family
Leaving your wife and children with nothing? The court can step in and force part of your estate to be used to support them.
3. Muslims Must Follow Islamic Inheritance Law
A Muslim cannot freely distribute all their wealth. Generally, only one-third can be gifted outside the prescribed heirs. The rest must follow Islamic inheritance rules.
4. Family Property Isn't Yours to Give Away
You cannot Will away communal or family property that you do not solely own. Such gifts can be declared invalid.
