INEC Overstepped its Boundaries With 2026 Party Defection Restriction - Arabambi

The INEC regulations derive their authority from the Electoral Act, and the Electoral Act itself derives from the Constitution, which is the supreme law of the land and binding on all authorities. Therefore, INEC must operate strictly within both the Constitution and the Electoral Act. Where the law sets clear timelines, such as 120 or 150 days, INEC cannot alter them unless the Act is properly amended by the National Assembly. Any action outside these limits amounts to an overreach of its powers and is inconsistent with the constitutional order.
