Supreme Court Judgement Gives FG Control Of Waterways But Not Surrounding Land - Taiwo-Nsirim

The distinction lies in the legal framework governing land and waterways. Under the Land Use Act, all land within a state is vested in the governor in trust for the people, while a recent Supreme Court judgment reaffirmed that states retain control over land within their territories, with the Federal Government’s authority largely limited to waterways of federal or international significance. This reinforces constitutional provisions on state boundaries and confirms the Court’s role in protecting coastal states when federal actions extend beyond constitutional limits.
