Defection: Section 77 of the Electoral Act Is Faulty, Conflicts with the Constitution – Mato

The Federal High Court’s judgment on INEC’s timetable was clear and straightforward. The court was asked to interpret sections of the Electoral Act, which is a product of INEC and the National Assembly. In interpreting those sections, the court applied their plain and natural meaning. For instance, Section 29(1) states that a party shall submit the list of candidates and their particulars not later than 121 days before the elections. INEC, in its own wisdom, decided to shorten that timeline. There can be no interpretation that expands or narrows that provision.
